This policy explains how Brand Digital Inc. ("Brand Digital", "we", "us"), a creative and digital agency located at 75 Rue Queen, Suite 1400, Montreal, Quebec H3C 2N6, Canada, handles personal information collected through this website and in the course of our business.

We comply with the Act respecting the protection of personal information in the private sector (Quebec, as amended by Law 25) and, where applicable, the federal Personal Information Protection and Electronic Documents Act (PIPEDA).

Information we collect

We only collect what we need for the purposes described below:

  • Contact and project forms: name, email address, phone number (optional), company, service of interest, budget range and the message you send us.
  • Direct communications: information you share when you email, call or meet with us.
  • Technical data: IP address, browser and device type, pages visited and timestamps, collected automatically by our hosting provider for security and site operation.
  • Client work: information our clients provide to us to deliver contracted services, handled under the terms of each agreement.

Why we use it

We use personal information to:

  • respond to your inquiry and prepare proposals;
  • deliver and manage the services you engage us for;
  • keep the website secure, prevent abuse and fix technical issues;
  • meet our legal, accounting and tax obligations.

Consent

By submitting a form or contacting us, you consent to the use of your information for the purposes above. We will ask for your separate consent before using it for any new purpose. You may withdraw your consent at any time by contacting us, subject to legal or contractual limits.

We do not sell or rent personal information, and we do not send marketing emails without your consent.

Cookies and similar technologies

This website uses only the technical storage needed for it to work, such as remembering your language preference. We do not use advertising or cross-site tracking cookies. If we introduce analytics or tracking tools that identify, locate or profile visitors, they will be turned off by default and we will ask for your consent first, as required by Law 25.

Sharing and service providers

We share personal information only with service providers who help us operate, such as website hosting, secure database storage and email. They may access it only to perform services for us and are bound by confidentiality and security obligations.

We may also disclose information where required by law, or in connection with a business transaction, under the conditions set by law.

Storage outside Quebec

Some of our providers store or process information outside Quebec, including elsewhere in Canada, the United States or the European Union. Before any such transfer, we assess whether the information will receive adequate protection, and we rely on contractual safeguards.

Retention and destruction

We keep inquiry information for up to three years after our last exchange if no engagement follows, and client records for as long as needed for the engagement plus the period required by tax and accounting law. When information is no longer needed, we securely destroy it or anonymize it.

Security

We use reasonable physical, administrative and technical safeguards, including encrypted connections (HTTPS), restricted access and protected storage. No method is completely secure, but we work to protect your information against loss, theft and unauthorized access.

Confidentiality incidents

We keep a register of confidentiality incidents. If an incident presents a risk of serious injury, we will promptly notify the Commission d'accès à l'information du Québec and the people affected, and take steps to reduce the risk.

Your rights

Subject to the law, you have the right to:

  • access the personal information we hold about you;
  • have inaccurate, incomplete or outdated information corrected;
  • withdraw your consent;
  • request that we stop disseminating your information or de-index it;
  • receive computerized information you provided in a structured, commonly used format;
  • file a complaint with us, and with the Commission d'accès à l'information du Québec (cai.gouv.qc.ca).

How to make a request

Send your request in writing to the person in charge listed above. We may need to verify your identity. We respond within 30 days of receiving your request, free of charge unless a reasonable fee is permitted by law.
